Abstract:

The WTO is currently gripped in a crisis because its dispute settlement system can no longer fully function due to the actions of the United States. The WTO Appellate Body is paralyzed because the United States will not approve any new members, leaving the Appellate Body without sufficient members to constitute a quorum. The talk will explain that the United States does not intend to revive the Appellate Body but to replace the WTO dispute settlement system with a parallel dispute resolution mechanism of its own making found in U.S.-led free trade agreements.
